CONCERNING
IMPORT DUTY RELIEF FOR GOODS WITHIN THE FRAMEWORK OF IMPLEMENTING THE BASIC AGREEMENT ON THE ASEAN INDUSTRIAL COOPERATION

THE MINISTER OF FINANCE,

Considering :

• a. that the Basic Agreement on the ASEAN Industrial Cooperation has been ratified by the government of the Republic of Indonesia by President Decree No.51/1996;
• b. that the Certificate of Eligibility under the Basic Agreement on the ASEAN Industrial Cooperation needs to be followed up with import duty relief for the import of goods as meant in the said certificate of eligibility.

In view of :

• 1. Law No.10/1995 on customs affairs (Statute Book of 1995 No.75, Supplement to Statute Book No.3512);
• 2. Presidential Decree No.51 /1996 on ratification of the Basic Agreement on the ASEAN Industrial Cooperation;
• 3. The Decree of the Minister of Finance No.440/KMK.05/1996 dated June 21, 1996 on the system of classifications of and import duty rates on import goods, as already amended or supplemented.

DECIDES:

To stipulate :

THE DECREE OF THE MINISTER OF FINANCE CONCERNING IMPORT DUTY RELIEF FOR GOODS WITHIN THE FRAMEWORK OF IMPLEMENTING THE BASIC AGREEMENT ON THE ASEAN INDUSTRIAL COOPERATION.

Article 1

The goods imported within the framework of implementing the Basic Agree-lent on the ASEAN Industrial Cooperation as contained in the Certificate of Eligibility shall be granted import duty relief, so that the rate of import duty becomes 5% (five percents) at the maximum.

Article 2

The import duty relief as meant in Article 1 shall be granted to companies already obtaining the Certificate of Eligibility from the ASEAN Secretariat.

Article 3

In order to obtain the import duty relief as meant in Article 1, the companies as meant in Article 2 shall submit applications to the Director General of Customs and Excise by attaching the certificate of eligibility.

Article 4

Based on the applications as meant in Article 3, the Director General of Customs and Excise shall issue decrees of the Minister of Finance concerning import duty relief for goods imported within the framework of implementing the Basic Agreement on the ASEAN Industrial Cooperation.

Article 5

The granting of import duty relief as meant !n Article 1 shall only apply to the import of goods accompanied by certificates of origin (Form D), which are signed by authorized officials in relevant ASEAN countries.

Article 6

This decree shall come into force as from the date of stipulation.

For public cognizance, this decree shall be announced by publishing it in the State Gazette of the Republic of Indonesia.
